In all my years advising commercial real estate clients, the deals that go sideways almost always have a legal component at the root — something overlooked, misunderstood, or addressed far too late in the process. Commercial real estate law is not the most exciting dinner conversation, but I promise you this: understanding the basics will protect your investment, your business, and your financial future in ways that nothing else can.

  • Signing leases without professional legal review — A commercial lease is a multi-year financial commitment with enormous operational implications.
  • Skipping or rushing title insurance — Title defects can surface years after closing and create devastating ownership disputes.
  • Ignoring entity structure — How you hold title to commercial property affects your liability exposure, financing options, estate planning, and tax treatment.
  • Treating environmental reports as optional — They are not optional. They are essential.
  • Missing easements and deed restrictions — These can fundamentally limit what you can do with your property and should be reviewed before closing.
